A High Court sitting in Kano State has on Monday struck out a suit filed by Kingmakers of Kano emirate challenging the creation of the additional new emirates in the state.
The presiding Judge, Court , Justice Ahmed T. Badamasi while giving the judgment struck out the suit filed by the Plantiffs counsel, Barrister Suraj Saida SAN.
The Kingmakers had filed a suit with the number K/197/2019 through its counsel challenging the creation of the new emirates of Bichi, Karaye, Rano and Gaya by the state government.
Joined in the suit were the Speaker, Kano State House of Assembly, Abdul Aziz Garba Gafasa, the State House of Assembly, Kano State Governor Abdullahi Umar Ganduje, Attorney General of the State, Ibrahim Mukhtar, Emir of Rano, Tafida Abubakar Ila, Emir of Gaya, Ibrahim Abdulkadir Gaya, Emir of Karaye, Dr. Ibrahim Abubakar II and Emir of Bichi, Aminu Ado Bayero.
In his ruling, Justice Badamasi said, “the judgment of my brother Justice Usman Na’aba in suit number K/192/2019 which is a judgment in rem, renders this suit mere academic exercise.
“That been the case, the suit deserves nothing order than to be struck out and same is accordingly hereby struck out,” the Justice Badamasi stated.
Our Correspondent recalls that a High Court sitting in Kano state, with the presiding Judge, Court 8, Justice Usman Na’aba had earlier struck out the suit of the Kingmakers seeking to challenge the creation of the new emirates.
The kingmakers who are challenging the creation of the emirates before the court include the Madakin Kano, Yusuf Nabahani, Makaman Kano, Abdullahi Sarki Ibrahim, Sarkin Dawakin Maituta, Bello Abubakar and Sarkin Bai Kano, Mukhtari Adnan
