A construction company, Bodmans International Technical Construction Nigeria Limited, has filed a suit before an Ikeja Lagos High Court against the chairman of Ifako-Ijaiye Local Government over the cancellation of a contract for the construction of Araromi market.
The claimant said officials of the first defendant frustrated the execution of the contract for the construction entered into by the local government authorities.
Also joined as defendants in the suit are Ifako-Ijaiye LGC and Alhaji Uthman Hamzat.
The claimant, in its statement of claim through its lawyer, Owolabi Dawodu, said they have made attempts to have the matter settled out of court with the defendants.
Additionally, the construction firm claimed that the first defendant failed to honour the terms of the contract agreement and its addendum.
Dawodu said, “Our office wrote the defendants intending to settle the matter amicably between the parties but all to no avail.
“We know as a matter of fact that letters have been written to your office and the Ministry of Local Government and Community Affairs of the Lagos State Government, but no concrete resolution of the contentious issues has been reached.
“The dispute resolution was unsuccessful and by a written memorandum to the defendants, we have on behalf of the claimant, set out their claims and option for settlement.
“Our client’s funds and resources are tied down to the project and this impasse is not helpful to either party’s cause. Consequent upon this, it shall be in the best interest of justice that this matter proceeds to litigation as it is the only way the claimant can be remedied.”
