A renowned and esteemed figure in Nigeria’s legal history, Chief Debo Akande (SAN), left an indelible mark on the nation’s judiciary system through his dedication to justice and commitment to legal excellence. This year marks two decades since his passing, yet his impact on the field remains palpable and influential.
Akande was not merely a lawyer; he epitomised hope and integrity within the legal profession. He adhered not only to the letter of the law but also to its spirit, relentlessly striving to ensure justice prevailed. His influential work in the landmark case of UTC (Nig.) Ltd. v. Chief J.P. Pamotei and others (1989) LLJR-SC revolutionised the Nigerian procedural law jurisprudence. Representing the appellant against the esteemed Chief F.R.A. Williams (SAN), who represented the respondent, Akande contended that a defendant’s statement of defence should be considered by the court even if an affidavit was not filed provided it presented a viable defence. The Supreme Court’s alignment with his reasoning established a precedent that has since been incorporated into Nigerian court rules.
Beyond his giant strides in legal practice, Akande was committed to making the law accessible to all, regardless of social class. In 1974, he became the Director of Operations for the Nigerian Legal Aid Association, an organisation aimed at providing legal aid to the underprivileged. This association’s efforts led to the enactment of the Legal Aid Act No. 56 of 1976, an essential milestone in public interest law in Nigeria. Akande’s contributions to the Legal Aid Council remain foundational, highlighting his selfless dedication to justice.
Akande’s integrity and unwavering commitment to fairness were evident throughout his career. His decision to resign from the Constitution Review Committee set up by the then military government upon realising its ulterior motives, underscores his principle that one must never compromise on truth and justice. His life was guided by the ethos encapsulated by Alexander Solzhenitsyn: “Let the lie come into the world, let it even triumph. But not through me.”
Akande exemplified the highest standards of mentorship, particularly to the legion of young lawyers who served under his guidance. His rare intellect was always at the disposal of those in need, and his door remained perpetually open, not just to lawyers but to anyone yearning to benefit from his vast reservoir of wisdom. He rendered equitable support to everyone and provided additional assistance to those in greater need. His profound knowledge, coupled with unwavering ethical standards, established him as an indispensable mentor and a beacon of inspiration for countless young lawyers who regarded him as both a role model and a guiding light.
The revised version improves clarity, enhances descriptive quality, and maintains a respectful tone towards Akande’s legacy. After many years of impactful practice, Akande was appointed the Chairman, Body of Benchers (the body of legal practitioners of the highest distinction in the legal profession), in 2004. He succeeded the late eminent jurist, Justice I.L. Kutigi. Despite his short stint in office before death came knocking, Akande served meritoriously and devoted his being to the development of the legal system in Nigeria to meet global benchmarks.
The accolades from esteemed figures, including the late human rights activist, Chief Gani Fawehinmi, who described Akande as “a man of high integrity” who “loved the people of this country,” reflect the high regard in which he was held. These tributes capture the essence of Akande’s life and the profound impact of his selfless service.
The law firm Debo Akande & Co., founded by him, has now evolved into Debo Akande LLP with a more youthful and vibrant outlook on the law. Under the management of his two sons, Adedayo Debo Akande and Adeboye Debo-Akande, the firm continues to specialise in private equity transactions, taxation law, family law, and corporate governance. It remains committed to the principles of hard work, a passion for the law, and uncompromising integrity—the same foundations upon which Akande built the firm.
As we commemorate the 20th anniversary of Akande’s passing, we honour his memory and the significant contributions he made to justice and humanity. His legacy endures, inspiring future generations to emulate his dedication and principles. Although he is dearly missed, the impact of his work continues to provide solace and inspiration.
