The Federal High Court sitting in Asaba has refused to give judgment on the suit brought by Governor Ifeanyi Okowa’s aide, Mr Wisdom Meddon, against the Inspector-General of Police, Usman Baba, and the Commissioner of Police, Delta State, Mohammed Ali and others.
In suit no FHC/ASB/CS/24/2022, the applicant is seeking an order of mandamus compelling the respondents to perform their statutory and public duties of arraignment and prosecution of Dr Sylvanus Ebigwei and 13 others for conspiracy and giving false information to the Nigeria Police.
Hearing the motion, the presiding judge, F. Ogunbanjo refused the applicant’s prayers, noting that there were pending applications before the court.
“The court cannot deliver judgment when there are pending applications before the court and we will address them whether we can hear the motion or deliver judgment. But the court must hear those motions,” the judge ruled.
In an interview with the counsel to the 14 respondents, N.W Ogbogwu said the judge could not deliver judgment on their motion for mandamus to compel the IGP and Delta CP to prosecute Ebigwei and others.
“So, we quickly filed an application for us to be joined and praying the court to strike out their application that we are interested parties,” he added.
The Ugoani of Okpanam, Mbanefor Ogbolu, Meddon and his legal team declined comment.
