In the suit, Tom-West is asking the court to order the Independent National Electoral Commission not to recognise Fubara as the governorship candidate of the PDP in the state.
He is also asking the court to restrain the PDP from presenting and submitting Fubara’s name as the candidate of the party to INEC.
Tom-West insisted that the process through which Fubara emerged was faulty.
This was contained in a sixty-one-paragraph affidavit presented by counsel for the plaintiff, Ibrahim Idaiye.
The suit claimed that PDP announced the name of Fubara as the winner, contrary to the terms and guidelines of the Electoral Act 2022.
The affidavit, sighted by our correspondent, disclosed that Fubara, who has been paraded as the governorship candidate of PDP, did not win the majority vote of delegates during the governorship primary that were conducted on May 25, 2022, and therefore asked the court to disqualify him in the interest of justice and fairness.
